service provided or items supplied by Chase Designs UK for the client on their
request and as described on our website www.chasedesigns.uk.
2. 'You' or 'Client' or 'Customer' is a person, persons, business or
organisation using any of the services or purchasing any item provided by Chase
Designs UK.
3. 'We' or 'us', refers to Chase Designs UK.
4. 'Bespoke' is any item that involves embroidery or a custom design ordered by
the Client.

'We' or 'Our' or 'Us' is Chase Designs UK or representative thereof.
General
1.
The contract between Chase Designs UK and the client will be on these
conditions, to the exclusion of all other terms and conditions. Any variations
to these terms and conditions shall have no effect unless agreed by both
parties in writing.
2. The works to be carried out shall be as set out in the Chase Designs UK invoice
which can be found attached to the confirmation order email.
3. Access to our website is permitted on a temporary basis, and we reserve the
right to withdraw or amend the service we provide on our site without notice.
We will not be liable if for any reason our website is unavailable at any time
or for any period.

5. It is your responsibility to provide up to date information for your home/delivery
address and contact details. Amendments can be made where necessary by
contacting Chase Designs UK.
6. All our products are handmade and as such
may not be perfect, a handmade item not being perfect does not constitute a
faulty product and cannot be returned as such.
7. Orders placed cannot be amended once
payment had been made therefore please check your order before you checkout and
pay.
8. When you order a bespoke or custom item
you are purchasing a service as such this service is none refundable and Chase
Designs UK will not be held liable for the cost of your order.
9. If
you cancel or return a bespoke item/orders you agree to Chase Designs UK
charging a fee of up to £20 per item to cover the work involved.
Our liability
1. The material displayed on our site is provided without any guarantees,
conditions or warranties as to its accuracy. To the extent permitted by law,
we, and third parties connected to us hereby expressly exclude: All conditions,
warranties and other terms which might otherwise be implied by statute, common
law or the law of equity.
2. Chase Designs UK cannot be held responsible for anything adversely affecting
the Client's business operation, sales, or profitability that might be claimed
as a result of a delay in delivery time or delay in services provided by Chase
Designs UK.

Any liability for any direct, indirect or consequential loss or damage incurred
by any user/Customer in connection with our website or services provided, items
ordered or in connection with the/their use, inability to use, or results of
the use of our website or services provided, items ordered, any websites linked
to it and any materials posted on it, including, without limitation any
liability for:
• loss of income or revenue;
• loss of profits or contracts;
• loss of business;
• loss of anticipated savings;
• loss of data;
• loss of goodwill;
• wasted management or office time; and
• for any other loss or damage of any kind, however arising and whether caused
by tort (including negligence), breach of contract or otherwise, even if
foreseeable, provided that this condition shall not prevent claims for loss of
or damage to your tangible property or any other claims for direct financial
loss that are not excluded by any of the categories set out above.
4. We will not be liable for any loss or damage caused by a distributed
denial-of-service attack, viruses or other technologically harmful material
that may infect your computer equipment, computer programs, data or other

our negligence, nor our liability for fraudulent misrepresentation or

copies of our images is not allowed and would be a breach of United Kingdom

website is accessed from outside of the United Kingdom, it is done at own risk
and the visitor is responsible for compliance with the relevant laws of the
visitor's jurisdiction. The terms and conditions of this website are governed
by the laws of England and Wales. Jurisdiction for any claims arising in respect
of this website's content shall lie exclusively with the courts of England. If
any provision of these terms and conditions is found to be invalid by any Court
having competent jurisdiction, the invalidity of such provision shall not
affect the validity of the remaining provisions of these terms and conditions,
which shall remain in full force and effect.
Communication
1. It is the client's responsibility to inform us of any change in email
address so we always have valid contact details. We cannot be held liable in
any way for problems relating to communication issues if we are not supplied
with a valid and up to date email address.
2. It is important for the customer to keep
in contact with Chase Designs UK until their product/item is delivered. If an
item is paid for in full and a delivery address is not provided and no contact
is made for a period of 84 days then the product/item will be donated to a
charity or disposed of in any way that Chase Designs UK sees fit and any money
paid or payment already made will be non-refundable or transferable.

If a client resumes contact after three months from the date we last made
contact with them, we will provide a new quotation for the item or service and
any money paid or payment already made will be non-refundable or transferable.
Account Usage and Password Access
1. Upon opening an account
with Chase Designs UK it is the Customers (Clients) responsibility to set a
secure password that nobody else knows or has access to and keep that password
in a secure place and never reveal that password to another person.
2. Chase Designs UK will
not be held liable or responsible for any loss suffered by the Customer
(Client) resulting from the use of an account password.
Postage and Packaging
1. Our
standard delivery is 14 to 21 days, Chase Designs UK will endeavour to have
your item ready for dispatch with seven days and aim to post your item within
10 days although bespoke and custom designs may to up to 21 days to dispatch
and 28 days to deliver.
2.
Chase Designs UK use Royal Mail postage and we always obtain and retain a
postal receipt for each and every item that we send.
3.
Chase Designs UK will not be held liable for items that are delayed or items
that go missing in the postal process, we will however endeavour to obtain a
full refund from Royal Mail on your behalf.
Payment Agreement
1. The
payment process is managed and processed by PayPal and as such Chase Designs UK
will not be held responsible or liable for any problems with your payment,
payment amounts or missing payments.
2.
If you make a payment through PayPal and Chase Design UK do not receive the
payment amount in full or we receive payment in part only it is the Customer /
Clients responsibility to contact PayPal to rectify the issue and or pursue a
full refund.
3.
Chase Designs UK reserve the right to and will charge an admin payment
processing fee of up to £20 for any payment made in error or to process any
overpayment refund.
Cancellation and Refund Policy
1. Chase
Designs UK will fully comply with the United Kingdom laws and distance selling
regulations.
2. All cancelations must be submitted and
received in writing. If the Customer cancels an order or item before it is
dispatched then a full refund will be issued within 21 days.
3. Chase Designs UK will refund any item that
arrives in a faulty or damaged condition upon the return and receipt of for
mentioned faulty item in its original condition and with all original packaging.
4. Chase Designs UK will assess each
application for a refund on its own merits and assess if the original purchase
price is refunded or a percentage of. Postage costs will not be refunded
5. Any and all returns must be authorised by
Chase Designs UK before the Customer sends an item back, Chase Designs UK will
not be responsible for our held liable for and items returned without our authorisation.
6. If
the Customer changes their mind after delivery and Chase Designs UK accept and authorise
the return of the item, then the Customer must pay all return postage costs and
the return postage cost will not be refunded or covered by Chase Designs UK.
Variations
1. We may revise these terms of use at any time by amending this page. You the
Customer (the client) are expected to check this page from time to time to take
notice of any changes we have made, as these terms and conditions are binding
on you the Customer (the client). Some of the provisions contained in these
terms of use may also be superseded by provisions or notices published
elsewhere on our site.
Privacy

1. We process information about you in accordance with
our privacy policy, by using our site you consent to for mentioned processing
and you warrant that all data provided by you is accurate.
2. Chase Designs UK will never share your information
with any third party outside companies or organisations.
3. We will only ever use your information for our
records, accounts and to contact you about orders or payments and answer your
inquiries.
4. All our clients date is kept private and securely
offline.
5. Any data that you submit using a web form or email
will be held by Chase Designs UK as Data Controller and will be held securely
and in accordance with the General Data Protection Regulation for 12 months or
until your account with Chase Designs UK is cancelled, after that time we will
securely and confidentially destroy your data. Your data will not be disclosed
to any third parties without your consent or as otherwise allowed by the
relevant Data Protection legislation and will only be used for responding to
your query or processing your order (or purposes associated with that purpose).
You have the right to be informed about what data we hold about you along with
other rights set out in the legislation. Further information about your rights
